We offer legal advice on road transport issues

Road transports constitute a large part of Sweden’s transports of goods which can be explained by high demands on fast and flexible transports.

The growth of e‑commerce in recent years has entailed an increased demand for road transports, warehousing and other services required for the delivery of goods by e‑commerce companies to their customers (3PL). For companies that work proactively and strategically to ensure a smooth flow of their goods, from order to delivery, and know how to make use of this commercially, it entails great competitive advantages.

It is important to ensure that the value of the transported goods is protected

The carrier’s liability for cargo damage does not always provide full protection for companies transporting high value goods. The carrier’s right to limit its liability in damages for damage to the goods and the relatively short period of time within which a claim must be submitted are important to be aware of in order not to forfeit the right to compensation (e.g. NSAB). It requires knowledge and experience to safeguard rights in conjunction with transport of goods, for both carriers and transport buyers.

Questions in relation to road transports that you should consider:

  • Is there sufficient insurance cover in the company for the goods being transported?
  • Are there internal procedures for urgently submitting claims as a result of delays in the goods’ delivery, the damage or loss of goods during transport?

Our lawyers are experts in respect of the Law on Domestic Road Transports and International Road Transports (CMR) and the application thereof. We assist carriers and purchasers of transport as well as other third parties in the transport chain in order to safeguard their rights, which includes the entire spectrum from entering into transport contracts to an event occurring of goods being lost, reduced in value or damaged during a road transport. We also help to safeguard the rights of both customers and carriers in relation to public authorities in conjunction with international road transports (such as in conjunction with the execution of combined transports or cabotage transports).

We regularly provide legal advice in areas such as the following types of assignments:

  • Establishment and negotiation of framework agreements for the purchase or sale of road transports, including multimodal transports
  • Management of procedures for the purchase of transports with an international character involving multimodal types of transport and work with procedures in order to minimize the risk of customer responsibility for illegal transports arising.
  • Advice in goods insurance matters.
  • As counsel in disputes concerning road transports before courts or in arbitral proceedings, for example in the event of damage to goods or disputes related to regulatory requirements.
