The question of who should be liable as the “redare” of a ship has long been one of the most complex and controversial areas of Swedish maritime law. This question was recently put to the test in the Supreme Court’s judgment in case no. T 6909-22 “Baltic Cable”. The case highlights several interesting aspects of shipowner liability in modern shipping.

The Swedish rules on cabotage transport and posting will change on 2 and 21 February 2022

The Swedish government has decided on a number of new rules concerning cabotage transports, combined transports, transport customer responsibility for driving and rest times and posting of workers.

The Swedish Government decides on amendments to regulations on cabotage transports

The Swedish Government has now decided to implement changes in the regulations concerning the conditions for foreign hauliers' freight transport in Sweden and the responsibility for customers ordering such transports. The Government's decision was prompted by a judgment from the Court of Appeal over Skåne and Blekinge in case B 3209-20, on 5 May 2021.

Guidance judgment on the criminal liability for ordering a cabotage transport

The ordering of a road transport made by one of the largest freight forwarders in Sweden has been considered in accordance with the conditions for legal cabotage transports through a decision from the Court of Appeal over Skåne and Blekinge. The Court of Appeal, thus, changes the District Court’s judgment and acquits the freight forwarder. The central issue in the case was how the number of cabotage transports should be calculated.

One of the largest container ships in the world is still blocking the Suez Canal, an event which can have significant global consequences. Even Swedish interested parties such as the Port of Gothenburg may also be affected by the situation. The running aground is a clear reminder of the vulnerability of global transport chains, and sheds light on a number of important insurance issues.
