UPC – Unified Patent Court

A new European patent system, which will bring important changes to patent filing and enforcing patent rights in Europe, is expected to be launched in 2018.

The new system, will make it possible to get unitary effect for a European patent in 25 EU Member States ("MS") by one request. A new court (the Unified Patent Court; "UPC"), common to the MS, will have exclusive jurisdiction for future classical European patents ("EP") and Supplementary Protection Certificates ("SPC") as well as Unitary Patents ("UP").

The new package affects all technologically innovative entities – applicants for patents and patent owners – which will now need to decide their strategy, either to choose UP or to stay with the already existing patent systems, i.e. European "bundle" patents and national patents.

Inventors and innovative companies will have to navigate in complex UP system in order to avoid pitfalls but rather use the benefits of the system to their own advantage.
